Medical and Dental Professionals: Watch those Facebook and Twitter Comments!

You may want to remind your office staff (or yourself) not to post comments referring to patients on sites such as Facebook, Twitter, or other websites. Posting comments about patients or their care could violate HIPAA confidentiality rules.

Comments posted online may seem innocuous, but can have serious legal consequences. For example, a medical technician at Oakwood Hospital in Dearborn was recently terminated for comments made on Facebook about a patient, whom she referred to as a "cop killer". The patient was an alleged gunman accused of fatally wounding a policeman.

The MDA has also received calls from member dentists whose employees have made Facebook comments about patients. Help protect yourself and your professional corporation by developing a social networking policy for your office. Be sure to include a restriction on any unauthorized discussion of patients on Facebook or other sites.
